Hello,


I will be moving from my property and had renewed my contract before knowing this would be the case. And reading the terms of the contract I have the right of 14 days, these are the terms as written by BT:


The legal stuff

Your right to cancel

You've got 14 days from the day your service starts or kit arrives, whichever is latest, to cancel.


So I spoke to them today but could not get through to the legal team at all since they only work mon-fri (which is fine) and the customer service advisor said "oh that's just wording" to which my response was, wording is important in a contract, it doesn't specify if kit needs to be new or old but it says "whatever is latest", which is important and from my old knowledge of contracts I'm aware of how vague this is but it could also be a loophole.


Since I've spoken to someone from the faults/tech team they've said I should have been sent out the new box which is for the fibre 2 service but he's the only one that mentioned it to me. Also, as he checked their system which told them that is what I needed for my broadband to be working as intended.


So my question is, to anyone who has a deeper understanding of contract law - do I still have the right to cancel 14 days when I receive this new box, since I have NOT received the kit as advised on the phone?


The other option that I have before calling back on Monday to the legal team is that I've got the engineer to come out and if they can't get my speeds up then I can leave cancellation fee free but that is not until end of November.


I just want to caveat that I am happy to pay the cancellation fee which is hefty should it come to it, however since I've had many speed issues that I've reported and unresolved; I thought I'd try to find options to get out of this without paying that cancellation fee as I'm sure anyone in my position would.


Any help would be appreciated!

Now I have to make a point of going there. Does anyone else remember a really affordable basement cafe run by the church in a street off of Golden Square? parallel to Regent Street? I also used to love the Vegetarian cafe on Neal Street in the basement (Neal Street Cafe?) and there was an inczredible inexpensive authentic Japanese resturant I use to go to with my Japanese friends (who introduced me to it) tucked away behind Long Acre where that brown brick modern building ('modern' I think it went up in the 90's!) now stands that fronts Long Acre and Neal Street..I think it was called Asakasa or something?
