What is his source for road ownership? If it is an adopted road owned by Southwark Council the council should have a copy of the legal order. If it is owned by Network Rail (or successor) the Marlin Plan will show the land ownership boundaries. If it is owned by the developer the Land Registry should have details. John K

  10. I thought that Thames Water is now a mandatory statutory consultee. Thames Water will address the impact on the Station Rise sewer. This sewer was originally built between 1865 and 1873 and sized for three small Victorian domestic premises. It may be neccessary for Railway Rise to have a new sewer system with interesting Grove Vale excavations to make the join. Pehaps the non-consultation with Thames Water is an oversight. John K

The conclusion was that the owner, because of the length of occupancy, has rights which predated and are preserved by the current (1988) legislation. And also (If anyone wants to read it): http://www.legislation.gov.uk/ukpga/1988/52/section/34 Where Section 34(3) has: "3) It is not an offence under this section to drive a mechanically propelled vehicle on any land within fifteen yards of a road, being a road on which a motor vehicle may lawfully be driven, for the purpose only of parking the vehicle on that land." Mr Barber says a Southwark Council worker now has discovered a new offence. - "Southwark Council after many years has worked out how to give those cars tickets". However... A few weeks ago a Southwark Council operative hoisted the red car on to a Southwark branded tow lorry. After a three-way discussion between a parking warden, the lorry driver, and someone else on the other end of a telephone, the car was hoisted back to the private land. So at the time of the immediate alleged offence: A] the car owner had not parked the there, and B] the car was not driven across the kerb or the public pavement. On 16 april 1910 Siduhe wrote: "In short, unless he can show he picked up the car and dropped it into place without going across the rest of the pavement, he's committed an offence." I would like to know about this newly discovered offence that relates to non-public property. John K
