Mini micro scooter query

I saw my godson yesterday on his second hand mini micro scooter that someone gave to my friend. It's quite an old one. Prob third hand at least. It doesn't have a brake so was contemplating sending one in the post. But before I do can any one help me with this: when he rides on it the front wheels splay out at the bottom (about 20-25 degree angle) so the platform goes v close to the ground. Now I've seen a lot of scooters but never seen this. My son's doesn't do it. Is this a problem? Can it be remedied?
