Sydenham Hill Traffic

The traffic lights at the junction of the A205 and Sydenham Hill are on red for so long that every morning there are huge hold-ups of traffic coming down the hill.

yesterday I was stuck behind this for so long that I assumed the right hand turn light was out of order. After about 10 mins wait everyone went for it. It was only as I went across that I saw filter was still red and I had shot a red light. Didn't see a flash of camera but was making a judgement that it was out of order. Is that a defence?
