  2. We have a fairly flimsy alumninium loft ladder that I am too terrified to use - particularly as it has to abut a landing at the top of the stairs. I always have visions of it coming loose and plunging ladder and all down the stairway. Does anyone have anything more sturdy that they would recommend I replace it with? Is a wooden ladder better?
  3. What DaveR said. A legal charity is not the same as the common usage of the word charity. If it was called a fundleswop instead, would it raise the same ire?
  4. I wonder how many people commenting on the law in this case have actually read the law of either sexual offences or evidence. I was going to get into the whys and wherefores of consent, but I suspect it will just wind me up, particularly when so many inferences are being made just in the context of this thread. I will leave you with the only point that Ian left out from "The Secret Barrister"'s blog post: 10. What does this whole affair say about our society? Christ knows. Nothing good.
  5. A verdict of not guilty doesn't mean he is innocent. It just means that there was not sufficient evidence to prove his guilt beyond reasonable doubt. "Drunken consent" is not consent if the person lacks capacity. There are a whole heap of things that concern me about this case, including the inferences that were allowed to be drawn from the similarity of language that was clearly uttered after penetration and therefore after the point where he was obliged to obtain her consent. However, the thing that bothers me the most though is the incorrect assertions that are now being made by lay people as to the law where rape is concerned.

  7. My pine floors were sanding back and stained to a medium antique oak colour. The problem with that in wet areas is that, as well as maintenance issues, you can get fungus in the wood which causes white/blue blooms when you refinish. It wasn't apparent on mine until the varnish went on, and was quite tricky to deal with. I wouldn't do it in a bathroom.
  8. It isn't legal, but when the call originates outside of the country there's not much that the authorities can do to enforce it.

The "reversability" of Art. 50 has come up because it is a point of law that needs to be settled in the current legal proceedings against the government arguing that Art.50 must be triggered under an act of parliament rather than by the executive. Basically, the Remainer claimants are arguing that the triggering of Art.50 is irrevocable, so effectively the government is using the royal prerogative to disenfranchise the UK people of their rights - something that constitutionally can only be done by Parliament. The government counsel has argued that Art.50 is reversible, which would undermine the claimants' argument. I've not seen anything about Donald Tusk saying it is reversable, but as a point of law the only court which would have jurisdiction to decide whether it is or not, is, ironically, the ECJ.

  11. I can't see how they have much choice. Any softer option is inviting further seperatism, particularly given the rise of fascist-like nationalism in other EU countries.
  12. Vinyl is great these days. I have stone effect vinyl in the kitchen which is easy to clean and warm underfoot, and will be doing the same with our bathroom.
  13. I disgree they would be bust by now. Maybe in 20 years when the fuel revenues dry up, but not within a year. If they did get independence + EU membership, Edinburgh could easily become the new City - Scotland already has a lot of funds/AM activity. From having spoken to plenty of folks in professional services, given the choice between relocating to Dublin, Frankfurt or Edinburgh, the Scots win every time. This is clearly all very theoretical as their is no vires for a second referendum, but I still think morally they have the right to feel aggrieved.
  14. Interesting quote! I wonder if that concern partly explains the difference between the civil and common law approach? EU law is infuriatingly nebulous at times, but at least it keeps you focussed on the principles.
  15. Except that the EU is unlikely to accept single market access and limitations in EU migration. Look at what happened when Switzerland tried to restrict immigration. So we either get something that is pretty much the same as being in the EU, without any ablity to influence the legislation we have to comply with or we lose at least some sections of the financial markets and, depending on what happens with passporting, potentially London ceases to be a major hub. Roll on redundancies. As one trader said to me many years ago "Sh*t runs downhill".
  16. Not proportionately. Obviously, I am secretly hoping they are made independent and overcome the Spanish objections to become a member of the EU so that the financial markets move north rather than east or west. Sunshine is overrated anyhow.
  17. It was one of the central messages of the Better Together campaign that they would only benefit from EU membership if they stayed in the UK. Why should they (or NI for that matter) be saddled with our decision to leave? Scotland being held to ransom by Little England cannot by definition be populist.
  18. I realise she doesn't have a legal leg to stand on, but morally I think they deserve a second bite of the cherry.
  19. I love the Next CEO's solution to this: "inflation is coming, so the government needs to put in the infrastucture to deal with it." How about an integrated market that has meant we've had relative FX stability?

  22. They knew. The principled ones like Jeb Bush made their feelings clear from the start. The rest were constrained by the party. I doubt people will wake up. His latest behaviour is now leading to people running around with "Bill Clinton is a rapist" shirts on. As long as class snobbery exists in either direction, we'll have people voting against "the elite" even if it is in spite of their future.
