With all this legal knowledge and certainty that they have the law on their side, why haven't SSW been able to make anything stick? The council were discriminating, the council isn't abiding by planning permission, and so on.

UPDATE

What you mean is that the tree cutters are in Camberwell New Cemetery on the ground ADJACENT to One Tree Hill, NOT actually ON One Tree Hill, why can't you just be honest, with out distorting the facts?

Re: nesting birds, ssw played that card last year as well, so no surprise they are using it again, and by the way ssw what happened to the racial discrimination you were shouting about and oh then their was the issue of WW1 garves, both quickly forgotten by ssw now they have nesting birds, really so are so predictable. Your group is a bit like a magpie, picking the silver object of the moment before moving onto something else.

There are perhaps a couple of things worth noting. The first is that the general legislation bars the disturbance of 'nesting birds'. It sets out no dates for this, and indeed different birds will nest at different times at different latitudes (and indeed depending on local climate). Southwark Council well may have 'rule of thumb' guidance as to dates - thereby precluding normal working during those times. However, because of the interference of ssw there have been hold-ups in their plans, and there is nothing, in law, to stop their work where there are no nesting birds to be disturbed. [indeed, and as an additional issue, I believe that where there are safety issues regarding the state of the tree the 'nesting bird' rule can be ignored, not least because a tree collapse in itself would somewhat disturb the birds.]

As to the timing condition placed on the work - as I have said, there is no legal definition of 'bird nesting season' - there are accepted windows certainly, but without the weight of law - so I believe such a condition, though I am sure entirely worthy - is also entirely challengeable as having no actual meaning in law. So long as Southwark can demonstrate that they have checked for nesting birds (and not found any where they are working) they can argue that it is not 'bird nesting season' where they are active. The underlying law, as I have said, is about the disturbance of nesting birds, and is not date related.

Wood chips from oak trees, cut down on the side of One Tree Hill in the Camberwell New Cemetery grounds, adjacent to the One Tree Hill Nature Reserve and the One Tree Hill Allotments. Some of the trees in the distance are on the Nature Reserve land.

This land is being prepared for 122 burial spaces - or seven or eight months supply.

"Wood chips from oak trees, cut down on the side of One Tree Hill in the Camberwell New Cemetery grounds, adjacent to the One Tree Hill Nature Reserve and the One Tree Hill Allotments". So for once Blanche and co of ssw actually do listen, well that's a first for them.
It's good to see the chips there - presumably some sort of mulch. Seems a good deal for two-thirds of a year usage. Remembering how much value the relatives of those lying there will be placing on having a local cemetery to be able to visit. And in a nice setting. Do remember that graveyards may contain the dead, but they are there for the living. Hence the somewhat lack of tragedy when the dead that have been buried so long they have no living relatives or friends are 'moved' in one way or another to make way for a further generation of interments.

Tree Cutting continues today on One Tree Hill, next to the One Tree Allotments and the One Tree Hill Nature Reserve.

Oh dear oh dear oh dear.

Much as I find these threads quite ammusing, I actually find SSW pretty offensive. Completely dishonest and incapable of proper debate.

Statement:

Felling trees on One Tree Hill in bird nesting season proves Southwark not fit to run burial service

22nd March 2017

Southwark's planning application categorically promised ?No felling is to take place in bird nesting season? (Area D1 Design & Access Statement, para 3.2.13). But Southwark starting felling on Friday 10th March without an ecologist on site to ensure no bat roosts or nesting birds were disturbed.

Why the rush to move forward on such a destructive project? Southwark says these 122 burial plots are needed to stop Southwark from ?running out? of burial space.

But something is very wrong if - almost 20 years into their permanent ?burial crisis? - Southwark needs 122 plots immediately or in-borough burial will stop.

Friends of Camberwell Cemeteries was founded as Save Southwark Woods to stop the destruction of the woods and graves of Camberwell Old and New Cemeteries.

We are for maintaining recreational activities already taking place on cemetery grounds, such as the Recreation Ground and the Allotments.

We are for preserving the cemeteries as Memorial Park Nature Reserves, like Nunhead or Highgate Cemeteries.

They definitely are. I know this because Lewis shouted at me and threatened me when I questioned SSW's vision for the cemetery, while Blanche stood behind him meekly and then justified his behaviour.

It was pretty hilarious, looking back.

We have responded to Cllr Wingfield's denial that Southwark's burial policy is discriminatory.

"Cllr Wingfield appears to be claiming that all Muslim residents could be buried in Southwark - if only they changed their religious burial rites. This is clearly discriminatory.

He states ?we have a dedicated Muslim burial area which has space for 48 grave plots?.

The ONS reports around 9 deaths per 1,000 per year, meaning Southwark?s 30,000 Muslim residents experience approximately 270 deaths a year. Southwark buries 7 Muslims"

Religious discrimination in burial provision is just one reason why burial cannot continue in Southwark's cemeteries.

Normally @savesouthwarkwoods RTs all praise and support in double quick time - nearly three hours ago UKIP posted their support in the London Assembly for the group and yet they haven't acknowledged it; any reason? Considering news updates are coming in almost daily from Blanche and Lewis I can't see why their case being heard in the London Assembly wouldn't get promoted and sent to the papers, Private Eye, Bianca Jagger, etc.

    • Hello! We are relocating abroad and so will be withdrawing our two children (ages 4 and 6) from St Dunstan’s College (Catford). If any family is considering enrolling children of a similar age, now would be an excellent opportunity—we’re required to pay full‑term fees unless the places are taken. Please get in touch if you’re interested or know someone who might be. Thank you!

    • Hi, I saw your post and just wanted to say that the incident you’re referring to did happen in the late 1980s at Dawson’s Heights. The person involved was named Carl Salawa, and he had just turned 18 years old at the time. Like you, I haven’t been able to find any news articles or official reports about it, If anyone remembers anything more about that time or incident, I’d really appreciate hearing about it. Thanks for sharing what you were told—it means a lot to know others remember.
