  1. Silverfox - she asked for opinions. Which I have given. I think Tallulah did the right thing in telling the person about picking up litter. However I don't think that comment she made that I quoted was productive and clearly resulted in further degeneration of the conversation. If you tell someone off in public there will be two outcomes 1. They are embarrassed and apologise 2. They argue with you In situation 2. I doubt you are going to be able to rationalise with the person. So it is probably best to walk away. There was nothing knee-jerk about the response.
  2. Sarcastic comment with potentially sinister undertones depending on how you interpret it or deliver it. No excuse for his response to you at all which was ridiculous but I don't think you helped the situation with that comment.

  6. Sounds like a case for constructive dismissal. You can't force people to resign, if they are not good enough they should go through formal disciplinary procedures and then be sacked. It is difficult as he is probationary period so I believe they can get rid of him anyway without real reason.
  7. They may be preferable but deciding based just on that basis is illegal.... If their own employee would be made redundant if they didn't get the job then it MAY be objective justification but this is not yet backed by tribunals...
  8. Otta, If you want to argue the case with HR email them with this... "I'm confused about your decision to not allow XXX XXX to apply for this role. My understanding was that under the Agency Workers Regulations of 2010 temporary workers had equal access to vacancies as permanent members of staff. I understand there is a provision for objective justification to not allow equal access. Are you saying that there is objective justification in this instance?"   9. I don't think there is a hard and fast law answer to this as the law changed in December 2011. There won't be enough case-law to back up any argument. The Agency Workers Regulations stemmed from the EU Agency Workers Directive. Essentially they give the same rights to facilities and vacancies (from Day 1) and pay equal to an internal permanent person in the same role (after Week 12). The law means that agency workers should be given the same visibility and right to apply for Permanent jobs as people working on perm contracts. There is a clause that gives "objective justification" for not allowing equal treatment and there has been some industry speculation that this may include redundancy situations. Ultimately the Agency won't have a clue as they are mostly muppets who are after a temp to perm fee. I think HR probably have a strong case on this one, but case law may prove this wrong. The acid test, is that if you mate doesn't get the job and someone less experienced does then they would have a case to go to tribunal. But not everyone wants to do that.
  10. I heard something on the Radio last night from Goose Green. Fairly sure it was 5 Live. They were interviewing people about whether they agreed with Hague's comments that businesses should stop moaning and there were 2 or 3 people given short sound bites... I was half listening so could be wrong.

  15. There is loads of free fitness activities on the what's on in East Dulwich. You don't need someone else to get you out of the house, JFDI. If you rely on other people if they lose motivation then so will you. We are blessed with nice parks round here. Walk, Jog, Cycle get your heart pumping. You only need to make the change for a couple of weeks then you'll see the benefits.

  17. I believe if you are standing on the crossing (e.g. the road) then the cars and bikes have a legal obligation to give way but not until then, so you should slow down, try and make eye-contact and wait till it is clear. Someone will no doubt be googling it now

Yeah very silly of the jogger to run out on a pedestrian crossing without stopping but it can be done. :( In the spirit of apologies, If the cyclist who I ran out in front of at Camberwell Green last night reads the forum then please accept my complete apology. I pride myself on being aware in most situations (opening car doors, crossing roads when walking) but had total leave of my senses and ran into the road in front of him. There was a queue of stationary traffic and I simply didn't look as I went to jog through the cars. Which was really stupid and nearly caused both of us some real damage. He must have seen the sheer terror and embarrassment in my face as I was apologising as he didn't make a big deal of it. I sometimes think if you are going on long jogs and getting tired you pay less attention the further you go on for fear of breaking stride or stop-starting. It shook me up, I hate jogging home but it helps my exercise-life balance. If anyone knows a nice car free, people free, litter free, traffic free, danger free route to run home from St Pauls then please let me know!
  19. I love Nero. I go most mornings before getting on the bus. Nothing like walking in there with 10 little stampy things and walking out with (the perception that you've had) a free coffee.

  21. Wii is fun for christmas and family gatherings but I don't personally think it is a serious fitness device. Sounds like you do more than enough already. Wii Fit has a Yoga program on it I think

You should change your introduction from "we both have to raise a certain amount of money in order to run" to "we decided to raise money for x charity because of x reason and as such are running the London marathon" The perception I get from your thread, and loads of emails see going round work and with friends is that many people piggy back on the charity bandwagon because they want the experience of running the marathon as a personal goal. I'd also say that you actually put some sacrifice in yourself, donate 10% of your salary on your own justgiving page, give up booze during the training period and donate that money. The birthday idea is a great suggestion. I hate the deluded self promotion (this isn't aimed at you now) that people convince themselves they are motivated by charity. I think lots of people just think, I'm a bit fat, or unfit, I can't motivate myself to do anything but I know, if I enter the marathon I'll have to get off my ass and do some running and then they wax lyrical about the charity that had the lowest minimum amount to raise for a bond place.

  24. Really enjoyed tonight - nice to meet you all. Having said I'll be there next week to people walking out, I've realised that I have a work event in the evening so can't. I'm defo keen for the long haul Michelle and keen to be involved in the next block booking. I'll be back two weeks from now for the season finale.
