Ladygooner
Anyone else received a claim form through the post from the US? Looks too real to be a scam? Apparently I am entitled to a partial refund of the fuel surcharge according to a settlement reached in a Californian law court for longhaul flights taken between Aug 11 2004 and March 23 2006. David Mc
I got that as well (and an email)! But I think you have to be able to prove that you were on the flights concerned and I'm not sure I have a way of doing that. Spark of inspiration - maybe air miles records are sufficient?! Ladygooner
Could be - although they are asking for a ticket number Link to comment https://www.eastdulwichforum.co.uk/topic/4120-class-a-lawsuit-relating-to-fuel-surcharges-ba-and-virgin/#findComment-130892 Share on other sites
AcedOut
I got something also. Looked very official, but couldn't be bothered to read it, so went straight in the bin. I figured the effort wasn't worth the reward, but perhaps I'll be proven wrong now... DaveR
There definitely is a class action is the US which has been settled and there have been announcements in the national press inviting those affected to make a claimWhether the form you have received is a scam or not I can't say, but I would expect the US lawyers to have obtained customer details as part of the discovery process, and they will want to recruit as many claimants as possible, so it may well be genuine. SimonM
It is real enough and has been in the pipeline for a while. You get back ?20 per flight you took during the period I believe. The problem for us is recalling the exact dates we used Virgin Atlantic to visit the US (we took two return flights) and I am wondering if Virgin themselves will supply this info if I ask them? David Mc
I only scanned the email and letter. If they want ticket numbers then there's no way I can claim. What sort of person keeps that sort of trivial detail for FOUR YEARS?! MrBen
I got it and reckon I'm due about ?200. You can avoid getting exact flight details if you have a BA /Virgin exec club card. I'm not loading the attachments as you can download them from the website.Dear Potential Class Member:This notification is being sent to you regarding a proposed settlement that has been reached in a class action lawsuit. The lawsuit alleges that British Airways Plc and Virgin Atlantic Airways, Ltd. unlawfully conspired to fix prices of fuel surcharges imposed on ?long-haul? passenger fares. Tickets must have been purchased between 11 August 2004 and 23 March 2006.Attached to this email are copies of the court-ordered Notice and a Claim Form that you can file to apply to participate in the Settlement. Members of the Class who file a valid claim will be paid 33.3% of the passenger fuel surcharge they paid on qualifying coupons. Refund payments will range between ?4 and ?20 per passenger per round-trip ticket purchased in the U.K. and between $7 and $34 per passenger per round-trip ticket purchased in the U.S.For more information about the terms of the proposed Settlement, please read the attached legal notice.
