Anyone else received a claim form through the post from the US? Looks too real to be a scam? Apparently I am entitled to a partial refund of the fuel surcharge according to a settlement reached in a Californian law court for longhaul flights taken between Aug 11 2004 and March 23 2006.

There definitely is a class action is the US which has been settled and there have been announcements in the national press inviting those affected to make a claim

Whether the form you have received is a scam or not I can't say, but I would expect the US lawyers to have obtained customer details as part of the discovery process, and they will want to recruit as many claimants as possible, so it may well be genuine.

It is real enough and has been in the pipeline for a while. You get back ?20 per flight you took during the period I believe. The problem for us is recalling the exact dates we used Virgin Atlantic to visit the US (we took two return flights) and I am wondering if Virgin themselves will supply this info if I ask them?

You can claim electronically if you want. Here's an email I received. I'm not loading the attachments as you can download them from the website.

Dear Potential Class Member:

This notification is being sent to you regarding a proposed settlement that has been reached in a class action lawsuit. The lawsuit alleges that British Airways Plc and Virgin Atlantic Airways, Ltd. unlawfully conspired to fix prices of fuel surcharges imposed on ?long-haul? passenger fares. Long-haul flights include most flights between the U.K. and non-E.U. destinations, including flights to and from the United States. All flights on Virgin Atlantic qualify as long-haul. Tickets must have been purchased between 11 August 2004 and 23 March 2006.

Attached to this email are copies of the court-ordered Notice and a Claim Form that you can file to apply to participate in the Settlement. Members of the Class who file a valid claim will be paid 33.3% of the passenger fuel surcharge they paid on qualifying coupons. Refund payments will range between ?4 and ?20 per passenger per round-trip ticket purchased in the U.K. and between $7 and $34 per passenger per round-trip ticket purchased in the U.S.

For more information about the terms of the proposed Settlement, please read the attached legal notice. You may also visit www.airpassengerrefund.co.uk. If you would prefer to file a Claim Form electronically, there is an on-line Claim process available on the website.

Please do not reply to this message. We are unable to respond to inquiries in reply to this email. If you wish to contact the Settlement Administrator, you may do so by writing to [email protected]. There is also an information helpline at 0 800 043-0343 (U.K. Free Phone).

This e-mail is being sent to potential Class Members as required by the Settlement Agreement and under Order of the United States District Court, Northern District of California, San Francisco Division. This is not a recurring email. Recipients can unsubscribe by clicking on the link below.

Sincerely,

Settlement Administrator

    • A new roadmap (surely railmap?!) for rail accessibility has been published: https://www.gov.uk/government/publications/accessible-railways-roadmap It says "approximately 56% of stations and around 66% of the 1.3 billion journeys that take place on the network have step-free access to platforms...  "£373 million has been committed over the next 5 years to deliver Access for All projects, providing step-free access from station entrances to and between platforms, alongside other essential accessibility upgrades. These works, together, will increase the number of step-free stations across Great Britain from 56% to 58%. "This improvement will make travel easier with step-free access available at stations covering an increased share of total rail journeys – from 66% up to 71%" Don't know what that means for us here: upgrading Peckham Rye would cover a lot of rail journeys but the cost has no doubt increased from the £40m figure previously quoted. So that would eat into a lot of the funding.
