Dear dulwichmum, Joking aside... Cycling on footways is prohibited by Section 72 of the Highway Act 1835, amended by Section 85(1) of the Local Government Act 1888. This is punishable by a fixed penalty notice of ?30 under Section 51 and Schedule 3 of the Road Traffic Offenders Act 1988. Assuming the cycling took place on a footway (a pavement at the side of a carriageway), as opposed to a cycle track, a pavement, a footpath, or highway, then, on the face of it, Section 51 and Schedule 3 of the Road Traffic Offenders Act 1988 appear to apply. Moreover, the legislation makes no exceptions for small wheeled or children's cycles, so even a child riding on a footway is breaking the law. However, when on 1st August 1999 new legislation came into force allowing a fixed penalty notice to be served on anyone breaching s72, the Home Office issued guidance on how the new legislation should be applied. It indicated that: it should only be used where a cyclist is riding in a manner that may endanger others. Also, (cut and pasted from the internet): At the time Home Office Minister Paul Boateng issued a letter stating that: "the introduction of the fixed penalty is not aimed at responsible cyclists who sometimes feel obliged to use the pavement out of fear of traffic and who show consideration to other pavement users when doing so. Chief police officers, who are responsible for enforcement, acknowledge that many cyclists, particularly children and young people, are afraid to cycle on the road, sensitivity and careful use of police discretion is required." Almost identical advice has since been issued by the Home Office with regards the use of fixed penalty notices by CSOs and wardens. So Dulwichmum, you need to ask yourself: were your little poppet and au pair riding in a manner that may endanger others? If you believe they were not - then you could try appealing against the FPN...but hurry...there are usually deadlines in which to do so. Hope this helps. xx

Now forgive me if I have got the wrong end of the stick here...but do you have the mind of a cesspit HAL9000? *absolutely ROARS with laughter*

I simply cannot imagine a woman of DM's breeding being unable to spell. Moreover, she would, almost certainly, have delegated the task of typing the OP to her Housekeeper. God forbid that those freshly varnished and beautifully manicured nails should get chipped. *tries very hard not to laugh*

SeanMacGabhann Wrote: ------------------------------------------------------- > I had you down as an anti-nanny-state type > LadyMuck? Hmmmm...did you now... So, just to clarify (and to get back on topic!), the question in my OP (i.e. "Is legislation the only answer to stopping this kind of waste?"), was precisely that: a question. I genuinely don't know the answer. It was not intended to be a statement saying that we should definitely implement anti-food-waste measures via legislation (although circumstances may compel this in the future). >...I'm not sure where you would start with legislation, > and fairly sure that enforcing any legislation > would be time-consuming and expensive... Most legislation is lengthy in process (and therefore expensive) as it has to go through 3 Readings and a Committee Stage before it can receive the Queen's Royal Assent and become an Act. Given the urgency of the matter (i.e. EU targets on CO2 emissions), the Government would need to ensure that a Minister introduces a Government Bill (as opposed to another type of Bill) as these have the highest chance of being passed.

Sorry dulwichmum, but whilst I appreciate the humiliation you undoubtedly suffered, on this occasion, "it's a fair cop"...anyway, what's ?30 to a woman with your disposable income/capital...(rhetorical question) *shakes head and laughs*

Huguenot Wrote: ------------------------------------------------------- > Legislation is always less effective than > challenging people's motivation... Whilst I agree that it is probably the case that the majority of citizens do not like to be dictated to...I do not believe that "Legislation is always less effective than challenging people's motivation". Anti-discrimination legislation (e.g. on sex and race) was, in my view, necessary in order to ensure a fairer deal for women and (e.g.) black people. As it is, it has not completely stopped discrimination on grounds of sex or race, but it has reduced it somewhat. Regarding the issue of food waste, the problem is not simply one of...you, Ladymuck, are wasteful because you threw away half a loaf of stale bread...it isn't that simple. Food waste has other consequences...e.g. the latest report by WRAP concludes that: "Throwing away food that could have been eaten is responsible for the equivalent of 20 million tonnes of carbon dioxide emissions every year ? that?s the same as the CO2 emitted by one in every four cars on UK roads. It?s not just the methane that?s released when the food goes to landfill that?s the problem, but also the energy spent producing, storing and transporting the food to us". The UK (in line with other EU countries) has EU targets to meet with regard to CO2 emissions. Can we realistically expect to see a reduction in waste sufficiently high enough to hit those targets without legislation?
